제1조 (목적)

본 약관은 OrbitLabs(이하 "회사")가 제공하는 Mind Oasis 모바일 애플리케이션 및 관련 서비스(이하 "서비스")의 이용에 관한 회사와 이용자의 권리·의무·책임 사항을 규정함을 목적으로 합니다.

제2조 (정의)

• "서비스": Mind Oasis 모바일 앱 및 부수적으로 제공되는 모든 기능
• "이용자": 본 약관에 동의하고 서비스를 이용하는 회원 및 비회원
• "AI 동반자 (다온)": 회사가 제공하는 인공지능 기반 대화 기능
• "프리미엄": 유료 구독 사용자가 이용 가능한 기능

제3조 (약관의 게시 및 변경)

1. 회사는 본 약관을 앱 내 설정 메뉴 또는 웹사이트에 게시합니다.
2. 변경 시 시행일 7일 전(중대 변경은 30일 전) 앱 내 공지 또는 이메일로 통지합니다.
3. 변경 후 계속 이용 시 동의한 것으로 간주됩니다.

제4조 (서비스의 제공)

회사는 다음의 서비스를 제공합니다:

• AI 동반자 다온과의 대화
• 감정 다이어리 (기록·달력·통계)
• 명상 음악 73곡
• AI 인사이트 알림 (프리미엄)
• 기타 회사가 정하는 부가 기능

제5조 (회원 가입 및 게스트 이용)

1. 회원 가입은 Apple ID, Google 계정, 또는 이메일로 가능합니다.
2. 게스트 모드(Apple Anonymous Sign-In)로도 이용 가능하며, 이 경우 일부 기능 제한이 있을 수 있습니다.
3. 만 14세 미만은 법정대리인 동의 후 가입 가능합니다.
4. 회사는 다음의 경우 가입을 거절하거나 사후 해지할 수 있습니다:
   • 허위 정보 기재
   • 타인의 명의 사용
   • 본 약관 위반

제6조 (이용자의 의무)

이용자는 다음 행위를 해서는 안 됩니다:

• 타인 명의 도용
• 서비스 운영 방해
• AI에 의도적 악의적 콘텐츠 입력 (혐오·차별·자해 유도 등)
• 다른 이용자에 대한 괴롭힘
• 저작권·지식재산권 침해
• 법령 위반

제7조 (유료 구독 및 결제)

7.1 구독 플랜

• 월간: ₩9,900 / 월
• 연간: ₩99,000 / 년 (월 ₩8,250 환산)
• 가격은 앱 내 공지 및 사전 동의 후 변경 가능

7.2 결제 처리

• 결제는 Apple App Store 또는 Google Play 결제 시스템을 통해 이루어집니다.
• 회사는 결제 정보(카드 번호 등)를 직접 수집하지 않습니다.

7.3 자동 갱신

• 구독은 만료 24시간 전 자동 갱신됩니다.
• 사용자는 갱신 24시간 전까지 Apple ID 또는 Google 계정 설정에서 해지 가능합니다.

7.4 환불

• 환불은 Apple/Google 플랫폼 정책을 따릅니다.
• 회사는 Apple/Google에 환불 결정 권한이 없습니다.
• 한국 전자상거래법상 디지털 콘텐츠 환불은 제공 즉시 사용한 경우 제한될 수 있습니다.

제8조 (서비스의 중단)

• 점검·시스템 장애·정전 등 사유 발생 시 서비스 일시 중단 가능
• 사전 공지 후 (긴급 시 사후 공지)
• 장기 중단 시 유료 사용자에게 일할 환불 또는 기간 연장 제공

제9조 (AI 응답의 한계 및 면책)

9.1 의학적 조언 아님 ⚠️

• 본 서비스의 AI 응답은 의학적 진단·치료를 대체하지 않습니다
• 우울·불안·자살 충동 등 심각한 정신건강 문제는 반드시 의료 전문가나 상담사와 상의하세요
• 응급 상황: 정신건강상담전화 1577-0199 / 자살예방상담전화 1393

9.2 AI 응답의 정확성

• AI는 100% 정확하지 않으며 실수할 수 있습니다
• 회사는 AI 응답의 결과로 발생한 손해에 대해 책임지지 않습니다
• 단, 회사의 고의·중과실이 있는 경우는 예외

9.3 콘텐츠 검열

• AI는 자해·자살 유도·혐오 콘텐츠를 거부하도록 설계되었으나 완벽하지 않을 수 있습니다
• 부적절한 응답 발견 시 support@orbitlabs.kr로 신고해주세요

제10조 (지식재산권)

• 서비스의 모든 콘텐츠(앱 UI, 코드, 캐릭터 다온, 명상 음악 큐레이션 등)는 회사에 귀속됩니다
• 이용자가 생성한 콘텐츠(감정 일기, AI 대화)는 이용자에게 귀속되며, 회사는 서비스 제공 목적으로만 사용
• 음악 트랙은 로열티 프리 라이센스로 제공되며, 재배포·상업적 재사용 금지

제11조 (계약 해지)

11.1 이용자의 해지

• 앱 내 설정에서 회원 탈퇴 가능
• 30일 보관 후 영구 삭제
• 보관 기간 중 동일 계정으로 복구 가능

11.2 회사의 해지

다음의 경우 회사는 사전 통지 후 또는 즉시 해지 가능:

• 본 약관 중대 위반
• 다른 이용자에 대한 명백한 위해
• 결제 사기

제12조 (손해배상)

• 회사의 고의 또는 중과실로 인한 손해에 한해 책임
• 통상 손해의 범위로 제한 (특별 손해 제외)
• 무료 사용자에 대해서는 배상 한도 없음

제13조 (분쟁 해결)

• 준거법: 대한민국 법
• 관할법원: 회사 소재지 관할 지방법원
• 이용자가 한국 외 거주자인 경우 한국 법 적용에 동의

제14조 (기타)

본 약관에 명시되지 않은 사항은 「전자상거래법」, 「개인정보 보호법」, 「약관의 규제에 관한 법률」 등 관련 법령을 따릅니다.

Article 1. Purpose

These Terms of Service govern the rights, obligations, and responsibilities between OrbitLabs ("the Company") and users of the Mind Oasis mobile app ("the Service").

Article 2. Definitions

• "Service": Mind Oasis mobile app and all related features
• "User": members and non-members who agree to these Terms
• "AI Companion (Daon)": AI-powered conversation feature
• "Premium": features available to paid subscribers

Article 3. Posting and Changes

1. The Company posts these Terms in the app Settings menu.
2. Changes will be announced 7 days before effect (30 days for material changes).
3. Continued use after changes constitutes consent.

Article 4. Services Provided

• AI Companion "Daon" conversations
• Emotion diary (logs, calendar, statistics)
• 73 meditation music tracks
• AI insight notifications (Premium)
• Other features as designated by the Company

Article 5. Sign-up and Guest Use

1. Sign-up available via Apple ID, Google account, or email.
2. Guest mode (Apple Anonymous Sign-In) available with some feature limits.
3. Users under 14 require legal guardian consent (Korean law).
4. The Company may reject or terminate registration for:
   • False information
   • Identity misuse
   • Terms violation

Article 6. User Obligations

Users shall NOT:

• Impersonate others
• Disrupt service operation
• Input deliberately malicious content to AI (hate, discrimination, self-harm prompts)
• Harass other users
• Infringe copyright or IP rights
• Violate applicable laws

Article 7. Premium Subscription and Billing

7.1 Plans

• Monthly: $7.99 / mo
• Yearly: $79.99 / yr ($6.67/mo equivalent)
• Prices subject to change with notice and consent

7.2 Payment

• Processed via Apple App Store or Google Play
• The Company does not directly collect payment info

7.3 Auto-Renewal

• Subscriptions auto-renew 24 hours before expiry
• Cancel anytime via Apple ID or Google account settings, at least 24 hours before renewal

7.4 Refunds

• Refunds follow Apple/Google platform policies
• The Company has no direct refund authority

Article 8. Service Interruption

• The Service may be temporarily suspended for maintenance, system failures, or power outages
• Prior notice will be provided when possible
• Long-term suspensions entitle paid users to pro-rated refund or extension

Article 9. AI Response Limitations and Disclaimer

9.1 NOT Medical Advice ⚠️

• AI responses do NOT replace medical diagnosis or treatment
• For serious mental health concerns (depression, anxiety, suicidal thoughts), consult a medical professional or counselor

9.2 AI Accuracy

• AI is not 100% accurate and may make errors
• The Company is not liable for damages caused by AI responses
• Exception: damages from the Company's intentional or grossly negligent conduct

9.3 Content Moderation

• AI is designed to refuse self-harm, suicide, or hate content prompts but is not perfect
• Report inappropriate responses to support@orbitlabs.kr

Article 10. Intellectual Property

• All Service content (UI, code, AI character "Daon", music curation) belongs to the Company
• User-generated content (emotion logs, AI conversations) belongs to the user; the Company uses it only for service operation
• Music tracks are royalty-free licensed; redistribution or commercial reuse prohibited

Article 11. Termination

11.1 User Termination

• Withdraw via app Settings
• 30-day grace period, then permanent deletion
• Recovery possible within grace period

11.2 Company Termination

The Company may terminate with notice or immediately for:

• Material Terms violation
• Clear harm to other users
• Payment fraud

Article 12. Liability

• The Company is liable only for damages from intentional or grossly negligent conduct
• Limited to ordinary damages (special damages excluded)
• No liability cap for free users (no damages possible)

Article 13. Dispute Resolution

• Governing law: Republic of Korea
• Jurisdiction: District court at the Company's location
• Non-Korean residents agree to Korean law

Article 14. Miscellaneous

Matters not specified herein follow applicable laws including the Korean E-commerce Act, Personal Information Protection Act, and Standardized Contract Regulation Act.
